This case arises out of a single-car accident on Highway 10 in Evangeline Parish, Louisiana. Two passengers were seriously injured and one was killed. Maurio Brown and Jesse Green, the surviving passengers, filed separate suits to recover damages for the personal injuries they sustained. Elaine and Willie Ballard filed a wrongful death action to recover damages arising out of the death of their son, Sean Brunson Ballard. Various parties were named as defendants, including Reginald Taylor, the driver of the vehicle, his insurer, Champion Insurance Company, *fn1 and the State of Louisiana through the Department of Transportation and Development (DOTD). *fn2 The three suits were consolidated for trial.
